OVERVIEW
Welcome to Danstack. In these Terms, "Danstack" refers to Danstack, a sole proprietorship operated by Danish from Kozhikode, Kerala, India, and "you" refers to the customer. Danstack sells Shopify theme sections and related digital products through this store and website, including all related information, content, features, tools, products and services (the "Services"). Danstack is powered by Shopify, which enables Danstack to provide the Services to you.
These terms and conditions, together with the policies referenced in them, describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully. They include important information about your legal rights and cover areas such as your licence to use the code you purchase, warranty disclaimers and limitations of liability.
By visiting, interacting with or using the Services, you agree to be bound by these Terms of Service and the Privacy Policy. If you do not agree, you should not use or access the Services.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence.
To use the Services, including purchasing any product offered, you may be asked to provide certain information, such as your email address, billing and payment information. You represent and warrant that all information you provide is correct, current and complete, and that you have all rights necessary to provide it. An accurate email address is essential, because your purchase is delivered to it.
You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - THE PRODUCTS
Danstack sells digital products: Shopify theme section code files and accompanying documentation. Every effort has been made to describe these products accurately on their product pages, including their features and their known limitations.
Screenshots, demonstration videos and the live demo on this site show the product configured with sample content. The appearance of the product on your own store will depend on your theme, your settings, your videos and your products.
Product descriptions are subject to change at any time. Danstack reserves the right to discontinue any product at any time. Discontinuing a product does not affect the licence you already hold for a product you have purchased.

SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Danstack reserves the right to accept or decline your order at its discretion. Your order is not accepted until payment has been received and processed.
Because delivery is instant and automatic on payment, an order generally cannot be cancelled after it is placed. Your rights after purchase are set out in the Refund Policy.
Your purchase grants you the licence described in Section 6. It does not transfer ownership of the code, and it does not permit resale, redistribution or repackaging of the code.

SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed, and will be set out in your order confirmation email. Prices are listed in Indian Rupees (INR).
Payments are processed by Razorpay. Danstack does not store your card, UPI or bank details.
You agree to provide current, complete and accurate purchase and payment information for all purchases. You represent and warrant that you are duly authorised to use the payment method you provide, and that charges incurred by you will be honoured by your bank or payment provider.

SECTION 5 - DIGITAL DELIVERY
All products sold by Danstack are digital. Nothing is shipped physically.
On successful payment, a download link is sent automatically to the email address you provided at checkout, and is also available from your order confirmation page. Delivery is normally immediate.
It is your responsibility to enter a working email address and to check your spam or promotions folder. If your download link has not arrived within 15 minutes of payment, contact dhanishdnz60@gmail.com or WhatsApp +91 79029 94307 with your order number and the file will be sent to you directly.
Danstack is not responsible for delivery failures caused by an incorrect email address supplied at checkout, or by your mail provider blocking or filtering the delivery email.

SECTION 6 - LICENCE TO USE THE CODE
This section governs what you may and may not do with the code you purchase. It replaces any general restriction elsewhere in these Terms.

6.1 What your purchase grants. Each purchase grants you a perpetual, worldwide, non-exclusive, non-transferable single-store commercial licence to use the purchased section code on one live Shopify store that you own or operate. This licence is expressly for commercial use: you may use the code on a store that sells products and generates revenue. That is what it is sold for.

6.2 What the licence includes. Under a single-store licence you may:

• Install and use the code on one live Shopify store.
• Install the same code on development, staging, duplicate and backup themes belonging to that same store, at no extra cost.
• Modify the code for use on that store, including changing its styling, copy and behaviour to suit your theme.
• Keep using the code permanently. There is no subscription, no expiry, and no recurring fee. If Danstack stops trading, your licence and your copy of the code are unaffected.
• Receive corrections and updates to the purchased product, when they are issued, at no additional charge.

6.3 What the licence does not include. You may not:

• Install the code on a second store, on a client's store, or on any store other than the one covered by your licence. Each additional store requires an additional licence.
• Resell, sublicense, rent, lease, distribute, publish or give away the code, whether modified or unmodified, whether free or paid.
• Include the code in a theme, template, plugin, app or product that you sell or distribute to others.
• Upload the code to a public or shared repository, file-sharing service, marketplace or forum.
• Remove or obscure the authorship comments contained in the code files.

6.4 Additional stores. If you need to use the code on more than one store, or on stores belonging to your clients, additional licences are available. Email dhanishdnz60@gmail.com or message WhatsApp +91 79029 94307 and you will be quoted for the number of stores you need.

6.5 Ownership. Danstack retains all copyright and intellectual property rights in the code. Your licence is a right to use, not a transfer of ownership. Modifications you make to the code for your own store belong to you, but the underlying code remains the property of Danstack.

6.6 Breach. Using the code outside the scope of your licence terminates the licence automatically. Danstack may then require you to remove the code from all stores on which it is installed. Danstack reserves all remedies available under applicable copyright law.

6.7 The rest of the Services. Everything on this website other than the purchased code — including the Danstack name and logo, page copy, product images, demonstration videos and documentation — remains the property of Danstack and may not be reproduced, republished or distributed without prior written permission. The Shopify name, logo and trademarks are the property of Shopify. All other trademarks appearing on the Services belong to their respective owners.

SECTION 7 - SUPPORT
Every purchase includes support for installing the product and for defects in the product as delivered and described. Support is provided by email at dhanishdnz60@gmail.com and by WhatsApp at +91 79029 94307, Monday to Saturday, 10:00 to 19:00 IST.
Support covers: installation help, questions about the settings, and fixing behaviour that does not match what the product page describes.
Support does not cover: custom design or feature work, changes to your theme unrelated to the product, conflicts caused by other apps or by heavy prior customisation of your theme, or training in Shopify or Liquid generally. Work of that kind can be quoted separately.

SECTION 8 - THIRD-PARTY TOOLS AND LINKS
The Services may link to, or interoperate with, websites, apps and tools provided by third parties, including your Shopify theme, your checkout provider and any apps installed on your store. Danstack neither monitors nor controls these.
Such third-party tools are accessed at your own risk and discretion. You should be familiar with and approve of the terms on which they are provided. Danstack is not liable for any harm or damage arising from your use of third-party websites, apps or services, or from changes those third parties make to their own products.
If a third party changes its product in a way that breaks compatibility with a Danstack product, Danstack will make reasonable efforts to restore compatibility, but does not guarantee it.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Danstack is powered by Shopify, which enables Danstack to provide the Services to you. However, any sales and purchases you make in this store are made directly with Danstack. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Danstack, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Danstack.

SECTION 10 - PRIVACY
All personal information collected through the Services is subject to the Privacy Policy, and certain personal information may be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside.

SECTION 11 - REVIEWS AND FEEDBACK
If you submit any ideas, suggestions, feedback, reviews, proposals or other content ("Feedback"), you grant Danstack a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use — for example, quoting a review on a product page.
You represent and warrant that you own or have all necessary rights to the Feedback you submit, and that it will not violate the rights of any third party. Danstack is under no obligation to keep Feedback confidential, to pay for it, or to respond to it.
Danstack may remove Feedback that is unlawful, abusive, defamatory, obscene, misleading, or that violates these Terms. You may not submit Feedback under a false identity or misrepresent your relationship to Danstack.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information in the Services containing typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions or availability. Danstack reserves the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders where information is inaccurate, at any time and without prior notice, including after you have submitted your order. Where an order is cancelled for this reason after payment, you will be refunded in full.

SECTION 13 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not use the Services: (a) for any unlawful or malicious purpose; (b) to violate any applicable law or regulation; (c) to infringe the intellectual property rights of Danstack or of others; (d) to harass, abuse, defame, intimidate or harm any person; (e) to transmit false or misleading information; (f) to send unsolicited advertising or spam; (g) to impersonate any person or entity; or (h) to engage in conduct that restricts or inhibits anyone else's use of the Services.
You also agree not to: (a) upload or transmit viruses or other malicious code; (b) reproduce, duplicate, copy, extract, sell or resell any portion of the Services except as permitted by your licence under Section 6; (c) collect or track the personal information of others; (d) attempt to phish, pharm or pretext the Services; or (e) interfere with, bypass or circumvent any security or authorisation feature of the Services.
Danstack may suspend or terminate your access at any time if you violate any part of these Terms.

SECTION 14 - TERMINATION
Danstack may terminate this agreement or your access to the Services at its discretion at any time, and you will remain liable for all amounts due up to and including the date of termination.
Termination of your access to the Services does not revoke a licence you hold under Section 6 for a product you have already purchased, unless that licence has itself been terminated for breach under Section 6.6 or following a refund.
The following sections survive termination: Licence to Use the Code, Reviews and Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, and Governing Law.

SECTION 15 - DISCLAIMER OF WARRANTIES
The information presented through the Services is made available for general information purposes. Danstack does not warrant the accuracy, completeness, or usefulness of this information, and any reliance you place on it is at your own risk.
EXCEPT AS EXPRESSLY STATED BY DANSTACK, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE', WITHOUT ANY REPRESENTATION, WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. DANSTACK DOES NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT ANY PRODUCT WILL BE COMPATIBLE WITH EVERY POSSIBLE THEME OR APP CONFIGURATION. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU.
Nothing in this section limits the 7-day money-back guarantee set out in the Refund Policy.

SECTION 16 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL DANSTACK, ITS OPERATOR, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SALES, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCT PROCURED USING THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.
WHERE LIABILITY CANNOT BE EXCLUDED, THE TOTAL AGGREGATE LIABILITY OF DANSTACK TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
You are responsible for maintaining backups of your Shopify theme. Danstack recommends duplicating your theme before installing any code, and is not liable for changes you make to your own theme.

SECTION 17 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Danstack, Shopify, and their affiliates, partners, officers, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to any third party arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

SECTION 18 - SEVERABILITY
If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed. Such a determination shall not affect the validity and enforceability of the remaining provisions.

SECTION 19 - WAIVER; ENTIRE AGREEMENT
The failure of Danstack to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of that right or provision.
These Terms of Service, together with the Refund Policy, the Privacy Policy and the Contact Information, constitute the entire agreement between you and Danstack and govern your use of the Services, superseding any prior agreements, communications and proposals, whether oral or written.

SECTION 20 - ASSIGNMENT
You may not delegate, transfer or assign this agreement or any of your rights or obligations under these Terms without prior written consent, and any such attempt will be null and void. Danstack may transfer, assign, or delegate these Terms and its rights and obligations without notice to you.

SECTION 21 - GOVERNING LAW AND JURISDICTION
These Terms of Service and any separate agreements under which Danstack provides you Services shall be governed by and construed in accordance with the laws of India. You and Danstack consent to the exclusive jurisdiction of the courts at Kozhikode, Kerala, India.

SECTION 22 - HEADINGS
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 23 - CHANGES TO TERMS OF SERVICE
You can review the most current version of the Terms of Service at any time on this page. Danstack reserves the right to update, change or replace any part of these Terms of Service by posting updates to this website. It is your responsibility to check this page periodically. Changes take effect when posted. Changes to these Terms do not reduce the scope of a licence you have already purchased under Section 6.
